Engagés is a trademark of Talent IQ Inc. headquartered at 26, Dufferin, Hampstead, Quebec H3X 2X6, Canada.

Use of the d’Engagés website (hereinafter the “Website”) constitutes reading, understanding and acceptance by the user (hereinafter the “User”) of all the general terms and conditions of use of the Website (hereinafter the “Terms of Use”) set forth below.

The Terms of Use are legally binding on the User and Engagés (hereinafter the “Parties”). The Parties are entitled to invoke the Terms of Use and to take all useful and necessary measures to ensure that they are respected.

Engagés reserves the right to modify the Terms of Use at any time and at its own discretion. Where applicable, Engagés will indicate the date of update at the bottom of this page. It is the User’s responsibility to consult the Terms of Use regularly to ensure compliance with them.

Continued use of the Website constitutes the User’s agreement to the Terms of Use and any updates thereto.

If the User does not agree to the Terms of Use, and any updates thereto, the User must not, or must no longer, use the Website.

DEFINITIONS

“Advertiser”: the legal entity placing an advertisement on the Website.

“Candidate”: the natural person submitting an application in connection with an advertisement.

“User”: the natural person using the Website, either an Advertiser or a Candidate.

USE OF THE WEBSITE

The Website enables Advertisers to place job advertisements and Candidates to find job offers.

The Website is accessible from any computer with Internet access and from any browser.

By creating an account on the Website, the User is responsible for maintaining the security of his/her account and is fully responsible for all activities that occur under the account. The User must immediately notify Engagés of any unauthorized use of the account or any other breach of security.

Providing false contact information of any kind may result in termination of the User’s account on the Site.

All advertisements on the Website are posted by organizations over which Engagés exercises no systematic control.

Engagés reserves the right to refuse any Advertiser and/or any ad that does not correspond to the mission and values of Engagés. Engagés authorizes the User to view and download any information contained on the Website solely and exclusively for personal, non-commercial use.

In the absence of express written permission from Engagés, any other use or exploitation of the information, including distribution, modification, reproduction, reuse, transmission or use for the purposes of derivative works, public or commercial, is strictly prohibited.

The User also undertakes, without limitation, not to:

  • use the Website for any purpose other than recruiting, being recruited or using recruitment services;
  • use the Website for illegal purposes or to solicit others to perform or participate in illegal acts;
  • use the Website for obscene or immoral purposes;
  • use the Website to harass, abuse, insult, harm, defame, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;
  • post a non-existent job or a job whose description is incomplete, misleading or inaccurate;
  • use information presented on the Website for commercial, advertising or traffic redirection purposes;
  • use the Website to conduct or send any surveys or contests;
  • use the Website in any manner that could damage, disrupt the security of, disable, overburden or impair the Website;
  • upload, post or otherwise transmit on the Website any virus, harmful, disruptive or destructive computer file, code or program;
  • use any robot, spider or other automatic device or manual process to monitor or copy any content on the Website;
  • transmit unsolicited bulk e-mail, chain letters, junk mail or any other type of e-mail;
  • attempt to gain or obtain unauthorized access to the Site or portions thereof.

Any violation of the Terms of Use or conduct damaging to the reputation of Engagés entitles Engagés to remove the content or to suspend, deactivate or delete the User’s account (without the possibility of re-registration). In addition, Engagés reserves the right to delete certain data at its sole discretion.

Engagés agrees not to use or disclose any information provided by the User for any purpose other than advertising and recruiting.

INTELLECTUAL PROPERTY RIGHTS

The Terms of Use do not grant the User any right to use the intellectual property of Talent IQ Inc. or that of third parties that may be contained therein.

Engagés’ intellectual property includes, but is not limited to:

  • all logos, drawings, graphics, photos, images, videos, trademarks, symbols, texts, phrases, words and all general content on the Website that are not already subject to intellectual property rights;
  • all software, APIs and materials used by the Website;
  • all databases operated by the Website;
  • all content offered by the Website for free download.

The User retains ownership of the intellectual property relating to the content he/she submits to Engagés. However, the User grants Engagés a license to use such content for the purposes of dissemination and promotion. This license is granted solely by the act of submitting content to the Website and is free, non-exclusive and perpetual.

DISCLAIMER OF LIABILITY, EXCLUSION OF WARRANTY AND INDEMNIFICATION

Engagés assumes no responsibility for the content, existence, nature, quality, legality, safety or suitability of the jobs advertised and therefore cannot guarantee the accuracy, reliability or veracity of the information contained in these websites.

Engagés cannot be held responsible for:

  • breakdowns or technical problems beyond its control which may interrupt the Website service;
  • any cause of inability to access the Website resulting from the use of the Internet, as well as any viruses that may result from such use;
  • any typographical errors or inaccuracies appearing on the Website;
  • any direct or indirect damage suffered as a result of using the services offered by Engagés.

The Candidate may leave the Website to access external content by clicking on a hyperlink. Engagés has no control over the content of these external sites and therefore assumes no responsibility for their accuracy, relevance, completeness, authenticity, security, timeliness or suitability.

Engagés cannot guarantee the confidentiality of information transmitted on the Website and cannot be held responsible for any damage caused by its disclosure. The User assumes full responsibility.

Engagés’ limit of liability shall not exceed the amount paid by the User for the services.

In the event that legal action is taken by Engagés as a result of a violation of the Terms of Use by the User or by any person having use of the User’s account, the User agrees to indemnify and hold Engagés harmless.

All rights granted to Engagés by the Terms of Use shall not constitute obligations for Engagés and Engagés may exercise such rights at its sole discretion.

INTERPRETATION

The subtitles are inserted for reference purposes only and shall not affect the construction or interpretation of the provisions of the Terms of Use.

JURISDICTION

The Terms of Use shall be governed by the laws applicable in the Province of Quebec. Any dispute arising from the use of the Website is subject to the jurisdiction of the courts of the district of Montreal, province of Quebec.
